Terms of Service

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create a myAiC account. myAiC is not directed at children under 13, and we do not knowingly permit anyone under 13 to use the service.

By creating an account you represent that the information you provide is accurate and that you have the legal capacity to enter into these Terms of Service ("Terms") with Lush Trading Post, LLC (d/b/a myAiC).

2. Account Responsibilities

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us promptly of any unauthorized use of your account.
• You may only maintain one personal account unless otherwise authorized.

3. Educational-Only Purpose; No Medical Advice

myAiC provides educational information about food, nutrition, and estimated blood-sugar impact. myAiC is not a medical device, is not a substitute for professional medical advice, diagnosis, or treatment, and does not diagnose, treat, cure, or prevent any disease or condition.

Always seek the advice of a physician or other qualified healthcare provider with any questions you may have regarding a medical condition, medication, or diet. Never disregard professional medical advice or delay seeking it because of something you read or saw in myAiC.

4. AI-Generated and Automated Analysis

myAiC uses artificial intelligence and automated rules to identify foods, estimate nutrition, and classify likely food impact. These outputs are estimates based on incomplete information and may be inaccurate, outdated, or based on incorrect assumptions about portion size or ingredients.

You should independently verify nutrition information against the physical product label or a qualified professional before making health-related decisions.

5. Nutrition-Data Limitations

Nutrition estimates, glycemic index approximations, and impact classifications (Green/Yellow/Red) are educational approximations only. They are derived from image analysis, barcode databases, and/or user input, each of which has inherent error margins. Actual nutritional content of any specific food item may vary.

6. User-Submitted Content

You retain ownership of content you submit (including photos and notes), but grant Lush Trading Post, LLC (d/b/a myAiC) a worldwide, royalty-free license to host, process, and analyze that content solely to provide and improve the service.

You represent that you have the right to submit any content you upload and that it does not infringe any third party's rights.

7. Camera and Photo Uploads

myAiC may request access to your device camera or photo library to scan meals, packaging, barcodes, or pantry items. You control this permission through your device settings and may revoke it at any time; certain features will not function without it.

8. Medication Reminders

Medication reminders are a convenience tool only. Reminders may fail to trigger due to device settings, notification permissions, connectivity, battery optimization, or other factors outside our control.

Medication reminders are not a medical device and are not monitored by a healthcare professional. myAiC does not provide dosing advice, does not adjust your medication schedule, and does not verify that a reminder was acted upon. Do not rely on myAiC as your sole method for managing medication timing for conditions where a missed or duplicate dose could cause harm.

9. Subscription Billing, Renewal, Cancellation, and Refunds

Paid subscriptions are billed in advance on a recurring basis (monthly or annually) through our payment processor, Stripe, and renew automatically until cancelled.

You may cancel at any time through Settings → Manage plan. Cancellation stops future renewal charges; you retain access through the end of your current paid period.

10. Acceptable Use

• No reverse engineering, scraping, or automated extraction of the service.
• No uploading unlawful, infringing, or harmful content.
• No attempting to interfere with or disrupt the service or its security.
• No impersonating another person or entity.
• No using the service to provide medical advice to others on our behalf.

11. Affiliate Links and Third-Party Services

myAiC may display affiliate links to third-party retailers, including Amazon. As an Amazon Associate, myAiC earns from qualifying purchases. myAiC may also integrate third-party services such as Stripe (billing), Supabase/Lovable Cloud (hosting and database), Resend (email), Google Gemini (AI analysis), and Open Food Facts (barcode lookup). Your use of those services is subject to their own terms.

12. Intellectual Property

The myAiC name, logo, application, and underlying software are owned by Lush Trading Post, LLC (d/b/a myAiC) and protected by intellectual property laws. Except for the limited license to use the app, no rights are transferred to you.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Lush Trading Post, LLC (d/b/a myAiC) DOES NOT WARRANT THAT NUTRITION ESTIMATES, AI OUTPUTS, OR REMINDERS WILL BE ACCURATE, UNINTERRUPTED, OR ERROR-FREE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Lush Trading Post, LLC (d/b/a myAiC) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, HEALTH OUTCOMES, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

15. Indemnification

You agree to indemnify and hold harmless Lush Trading Post, LLC (d/b/a myAiC), its officers, employees, and agents from any claims arising out of your misuse of the service or violation of these Terms.

16. Termination

We may suspend or terminate your account for violation of these Terms or applicable law. You may stop using the service and delete your account at any time via Settings.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated in-app or via email, and continued use of the service after the effective date constitutes acceptance of the revised Terms.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of New Mexico, United States, without regard to conflict-of-law principles.

Before filing a claim, you agree to first contact us at support@myaicapp.com so we can attempt to resolve the dispute informally. If a dispute cannot be resolved informally within 60 days, it may be brought in the state or federal courts located in New Mexico, United States, and you and myAiC each consent to the personal jurisdiction of those courts.
